It is not offered to individuals seeking employment.`, 'By registering, subscribing or using any part of the platform you confirm that you are authorised to bind your business to these terms.']], ['What Labour Tech is', ['Labour Tech is a business-to-business platform and service provider for construction workforce sourcing and statutory record-keeping. We operate two commercial models. The first is a platform subscription, under which verified businesses access the registered labour pool, publish or discover labour requirements and exchange bids. The second is a managed labour retainer, purchased per project site, under which our staff perform sourcing coordination and prepare and maintain the statutory labour records for the workers deployed at that site.', 'In both models we provide software and services. We do not perform construction work, we do not supervise or direct work at site, we do not employ the workers concerned, and we do not disburse wages.']], ['Labour Tech is not the employer', ['This clause is fundamental to the agreement. Workers introduced or made visible through the platform are not employees, agents or contractors of Labour Tech.', 'Where a hiring company engages workers, the engagement is between that company, the appointed labour contractor, and the workers concerned. Responsibility for wages, statutory contributions, working conditions, site safety, insurance, and all obligations under the Contract Labour (Regulation and Abolition) Act 1970, the Code on Wages 2019, the Occupational Safety, Health and Working Conditions Code 2020 and any other applicable labour legislation rests with the engaging parties and not with Labour Tech.', 'Labour Tech does not determine wages, does not supervise work, does not control hours, and holds no principal-employer or contractor status in any engagement arranged through the platform.']], ['Registration and verification', ['You must register with accurate business details, including your GST registration where applicable, and submit the documents we request for verification. Providing false or misleading information is grounds for immediate termination without refund.', 'Verification is a precondition of transacting. We may decline, suspend or withdraw verification at our discretion, including where documents cannot be validated or where a business is the subject of credible complaints.']], ['Subscriptions and payment', ['Access is provided on a paid subscription, priced by business type and quoted to you in writing against your stated requirement. Labour Tech is registered under GSTIN 27GCDPS7749F1Z0. Charges are stated exclusive of GST, which is added at the prevailing rate and shown on your invoice.', 'Subscriptions renew automatically for the same period unless cancelled before the renewal date. Payments are processed by our payment gateway; we do not store card details.', 'Refunds and cancellation are governed by our refund and cancellation policy, which forms part of these terms.']], ['Labour pool access and worker contact data', ['Subscriptions include a monthly allowance of worker contact reveals from the registered labour pool. Allowances are stated in your plan and reset each billing month. Unused reveals do not carry forward.', 'Worker contact details are disclosed to you for the sole purpose of engaging that worker through an appointed contractor for construction work. You must not copy, store beyond your legitimate need, publish, resell, share outside your business, or use worker data for marketing or any purpose other than that engagement.', 'A cooldown may apply, so that the same worker record cannot be revealed again \u2014 to you or to another business \u2014 for a set period after disclosure. This protects workers from repeated unsolicited contact and is applied at our discretion.', 'Every reveal is logged against your account. Bulk extraction, automated collection, sharing credentials, or any attempt to circumvent the reveal allowance or the cooldown is a material breach. We may suspend your account immediately, retain fees already paid, and pursue recovery of losses.']], ['The managed labour retainer', ['A managed labour retainer is purchased for one identified project site and covers the number of deployed workers stated in your accepted quote for that site. Each additional site requires its own retainer. The scope in force is the scope listed in your account and in the order confirmation at the time of purchase.', 'The retainer covers sourcing coordination from the registered labour pool, preparation and monthly maintenance of the statutory registers applicable to the deployed workers, preparation of wage sheets and bank payout files, preparation of contribution and deduction statements, support with returns filing and with registrations and cess returns, capture of attendance and of proof of payment, and a monthly audit pack. Deployment capacity is provided on a seat basis: a seat is a position at the site that may be filled by different workers over time.', 'The retainer does not include supervision of work, direction of workers, guarantee of output or productivity, payment of wages, statutory registration in our own name in respect of your workers, or legal representation. It does not make us a contractor, a manpower supplier, a staffing agency or an employer of record.']], ['Compliance facilitation, not a guarantee', ['This clause is fundamental and is repeated in your order confirmation. Under Indian law statutory obligations in respect of workers rest with the employer and, where applicable, with the principal employer. They cannot be transferred to a service provider by contract. Nothing in these terms transfers, assumes or shares that liability.', 'What we provide is facilitation: preparation of records, preparation of filings, timely reminders, and a documented evidentiary trail. We do not guarantee that your business is or will remain compliant, and we do not indemnify you against any assessment, demand, interest, penalty, prosecution or adverse finding by any authority.', 'Where a filing depends on information, approvals, digital credentials or funds that only you can provide, our obligation is limited to preparing the filing and notifying you within the timelines published in your account. Our invoices cover our service fee only, and GST is charged on that fee alone.']], ['Seats, replacements and the replacement timeline', ['Deployment is provided on a seat basis up to the seat count in your plan. Where a deployed worker leaves, we will use reasonable endeavours to mobilise a suitable replacement within seventy-two hours of the vacancy being recorded on the platform.', 'The replacement timeline is a service commitment, not a warranty of continuous site headcount, and it is subject to worker availability, seasonal supply conditions, the trade and skill grade required, site conditions and your own onboarding, access and induction requirements. Failure to meet it does not give rise to a claim for project delay or consequential loss; the remedy is the pro-rata fee adjustment described in the refund and cancellation policy.', 'Replacements up to twelve workers in a calendar month are included. Beyond that, replacements are charged at the published add-on rate. Workers are free to accept or decline any deployment, and nothing on the platform restricts a worker\u2019s right to work elsewhere.']], ['Retainer term, billing cycle and renewal', ['Managed retainers are purchased for a minimum term of twelve months and are invoiced quarterly in advance. The first invoice is raised on mobilisation and covers the first quarter together with any one-time onboarding or clean-up fees.', 'Platform subscriptions are billed monthly, or annually where an annual price is offered, and renew automatically unless cancelled before the renewal date. The compliance back-office add-on is billed monthly in arrears on the headcount actually administered in that month, subject to the published minimum.', 'Seat counts may be increased at any time and take effect from the next cycle. Reductions in seat count take effect at the next quarter with thirty days\u2019 written notice and do not reduce the minimum term.']], ['Scope of engagement and no execution work', ['Requests that fall outside the purchased scope \u2014 including site supervision, quality or output responsibility, statutory registration in our name in respect of your workers, disbursement of wages, or acting as your contractor \u2014 are outside this agreement. We may remove content and suspend accounts that breach this clause.']], ['Availability', ['We aim to keep the platform available but do not guarantee uninterrupted service. Planned maintenance will be notified where practical. We are not liable for statutory penalties, interest or assessments levied on your business, which remain your responsibility as set out in the compliance facilitation clause.']], ['Suspension and termination', ['You may cancel at any time; access continues to the end of the paid period. On termination your access ends and your data is retained or deleted in accordance with the privacy policy.']], ['Changes to these terms', ['We may update these terms.
